• transmitting or creating messages that are harassing, discriminatory, defamatory, fraudulent, or threatening, including offensive messages regarding race, gender, age, sexual orientation, religion, political beliefs, national origin, disability, ethnic origin, gender identity, or any other legally protected characteristic that could be considered discriminatory;
• transmitting, accessing, or storing any offensive or obscene materials or communications, as well as any information that violates applicable legal provisions;
• unauthorized distribution of confidential information;
• causing or facilitating security breaches in IT systems and/or disrupting communication within the network belonging to Rețele Electrice România;
• conducting activities that could jeopardize the security of THE SITE (cyber-attacks);
• violating any rights protected by copyright, trade secrets, patents, and/or other intellectual property rights, as well as any other similar laws or regulations through registration, copying, distribution, lending, and/or reproduction of THE SITE etc.

1.2. The user undertakes not to carry out actions that could damage Rețele Electrice România.

1.3. Any additional expenses related to the use of the services provided through THE SITE, including those charged by the user’s telephone or internet service provider, are the sole responsibility of the user.

1.4. The user agrees to immediately report to Rețele Electrice România any (i) violations of these general conditions, (ii) infringements of intellectual property rights related to THE SITE content, and (iii) commercial use of materials available on THE SITE if they become aware of such situations. Reports can be sent using the contact details provided on THE SITE’s “Contact” page.3

1.5. Individuals without full legal capacity and/or with restricted legal capacity may use THE SITE only for informational purposes and not for registering as a user. This rule also applies to the processing of personal data. By accepting these general conditions of use of THE SITE, the user declares under their own responsibility that they have full legal capacity.

2.2. The user is solely responsible for any damage caused to their access device (for example, but not limited to: laptop, tablet, smartphone, and computer) from which THE SITE is accessed, as well as for any other data loss that may result from using THE SITE.

2.3. The user agrees to hold Rețele Electrice România harmless and not take legal action against it regarding any claim made by a third party resulting from the use of THE SITE and/or the Rețele Electrice România communications network and the internet by the user, as well as regarding any loss (direct, indirect, or otherwise), costs, actions, lawsuits, claims, expenses – including legal fees – and/or other liabilities suffered in any way or directly caused to Rețele Electrice România as a result of the user violating or disregarding these conditions.

2.4. The obligations of Rețele Electrice România concerning THE SITE are governed exclusively by the agreements under which the content of this SITE is delivered and/or provided. No material or information on this SITE should be interpreted as altering commercial agreements in which Rețele Electrice România is a party.

2.5. Rețele Electrice România reserves the right to modify, at any time and without prior notice, the content of THE SITE (including but not limited to materials, services, prices, offers, etc.), with the user expressly declaring that they accept this clause. Such modifications shall be deemed tacitly accepted by the user if they continue to use the service after they are posted on THE SITE.

2.6. Rețele Electrice România does not guarantee the accuracy of THE SITE’s content. THE SITE may contain references to products, programs, and/or services that are no longer available. Additional information regarding currently available products, programs, and services can be obtained using the details provided in the “Contact” section of THE SITE.

2.7. Rețele Electrice România shall not be liable for any damages, direct or indirect, suffered as a result of accessing or using the information available on THE SITE that proves to be inaccurate.

3.2. Rețele Electrice România allows the viewing and downloading of materials from this SITE exclusively for personal, non-commercial use and only on the condition that all copyright notices and/or other intellectual property notices present in the materials from THE SITE are retained.

3.3. The following actions are strictly prohibited, including but not limited to: modification, reproduction, public display, performance, or distribution, renting, lending, use, commercialization of materials from this SITE, as well as the creation of derivative materials using the content and/or form of THE SITE. The use of these materials on another site and/or in any networked computer environment is prohibited.

3.4. Failure to comply with any of these general conditions will automatically result in the revocation of the right to use THE SITE, as well as the immediate destruction/return by the user of all downloaded and/or printed materials and the payment of damages.

4.2. In addition to the above, Rețele Electrice România recommends that the user constantly check the security policies of the browser used, as well as the terminal used to access THE SITE, ensuring that it has installed and updated software to protect against viruses of any kind or any external attacks such as cracking or hacking.

4.3. The user undertakes to provide valid data and information and to timely communicate any changes that occur.

4.4. The user understands that access to certain features of THE SITE may be restricted and accessible only to certain categories of users.

4.5. Users who compromise the security of Rețele Electrice România’s networks or systems or attempt to breach their integrity will face the legal consequences (criminal or civil) as determined by the applicable legal regulations.

5.2. Any inclusion of links to other websites or networks is done solely to assist the user and does not imply endorsement/confirmation by Rețele Electrice România of the material available on or through those websites/networks, nor any association with their operators. The user accesses those websites/links at their own risk.

5.3. Rețele Electrice România does not guarantee that services or materials provided by third-party sources are acceptable and available in any area of Romania. If the user accesses other content or services from the websites of other operators, Rețele Electrice România is not responsible for the user’s non-compliance with local laws and/or other applicable regulations in those countries.

6.2. The user’s refusal regarding the processing of personal data equates to the impossibility of providing certain electronic communication services, as well as making available the SITE’s services, and exempts Rețele Electrice România from any liability in this regard. If the user does not express their consent regarding the processing of personal data under this article, they may contact Rețele Electrice România using the details provided in the Contact section.

6.3. In accordance with the requirements of Regulation (EU) 2016/679 on the protection of natural persons regarding the processing of personal data and the free movement of such data and repealing Directive 95/46/EC of the European Parliament and Council (“Regulation”), and Law No. 506/2004 regarding the processing of personal data and the protection of privacy in the electronic communications sector, the mentioned data operators, as well as their authorized representatives, process and manage personal data collected from individuals for purposes such as user account administration, user inquiries resolution, prevention or detection of crimes or fraud, improvement of the SITE, and enhancement of user satisfaction.

6.4. The legal grounds for the processing of personal data by Rețele Electrice România are:

• the execution of a contract to which the data subject is a party or to take steps at the request of the data subject before concluding a contract;
• the express consent of the user;
• the legitimate interest of Rețele Electrice România, consisting of (i) taking measures to prevent fraud/crimes or (ii) continuous improvement of services provided by Rețele Electrice România.

6.5. Rețele Electrice România will process the following personal data of users:

• information regarding the index, consumption history, POD (acronym for “Point of Delivery,” designating a unique code for each measurement point), consumption location address, correspondence address;
• client identification information – information that allows the identification and contact of the user, such as name and surname, domicile address, Personal Numeric Code (CNP), current bank account, land registry/cadastral number, postal code, email address, telephone number, password.

6.6. The processing of personal data is carried out directly by the mentioned data operators, depending on the geographical area where the consumption location is situated, as well as by authorized representatives, in accordance with the Regulation, through manual/automated means, respecting security requirements for the processing of personal data. Personal data are disclosed only to authorized persons under conditions established by appropriate technical and organizational procedures to maintain the confidentiality of personal data, protect against accidental or unlawful destruction, loss, disclosure, or unauthorized access, in compliance with the law.

6.7. The user is responsible for keeping all personal data provided through this SITE updated. Rețele Electrice România reserves the right to periodically recommend or explicitly request either the reconfirmation of personal data provided through this SITE or the renewal of consent for the processing of personal data.

6.8. The processing of personal data is carried out in accordance with the dedicated section on personal data, which is an integral part of these general conditions.

8.2. By accessing this SITE, the user agrees that this contract and any dispute related to it are governed and interpreted in accordance with Romanian law, and the user agrees to submit to the exclusive jurisdiction of Romanian courts. This website may be accessed from anywhere within Romania and outside it (in other countries), as long as technical conditions allow it. Rețele Electrice România does not guarantee that the SITE complies with the laws (including intellectual property laws) of countries other than Romania. If the user accesses the SITE from outside Romania, they do so at their own risk and are solely responsible for complying with the laws of the territory they are in.

9.2. Any user can configure their browser to reject cookies. Disabling and refusing to receive cookies may make certain sections/pages impractical or difficult to visit and use.

9.3. Storing cookies on the user’s device provides an easy and convenient way to personalize or enhance the user experience on the SITE and to make the next visit more pleasant. Rețele Electrice România does not use cookies to collect personal information (for example, but not limited to: name, surname, identification data etc.). However, due to the IT technologies used, connections may be made between the information contained in a cookie and the user’s personal information collected by other means (for example, but not limited to registration forms).
